These Terms and Conditions ("Terms") govern the relationship between Singha Tham ("the Firm", "we", "our") and any person who engages or enquires about our legal services ("the Client", "you"). By instructing the Firm or making use of this website, you agree to these Terms. If anything is unclear, you are welcome to contact us before proceeding.
1. About the Firm
Singha Tham is a legal practice registered in Thailand, operating from 198 Mittraphap Road, Nai Muang, Mueang, Nakhon Ratchasima 30000. The Firm provides legal advisory and representation services relating to pension matters and related entitlements under Thai law. All practitioners hold current registration with the Lawyers Council of Thailand.
2. Scope of Services
The Firm offers three principal services, each confirmed in writing prior to commencement:
- Pension Position Assessment — A review of the Client's pension entitlements and a written summary of findings, provided at ฿2,490.
- Claim Preparation Assistance — Support in preparing and organising a pension claim or formal response, at ฿4,700.
- Sustained Support Programme — Ongoing legal support including correspondence and representation where needed, at ฿8,400 or as agreed in the engagement letter.
Services outside the above, or variations to scope, will be agreed in writing before any additional work is undertaken. The Firm does not commence work on the basis of verbal agreements alone.
3. Engagement and Instructions
An engagement begins when both parties have signed an engagement letter or service agreement confirming the scope, fee, and expected timeline. No work will be billed before this confirmation is in place.
The Client is responsible for providing accurate, complete information relevant to their matter. The Firm cannot be held responsible for outcomes affected by incomplete or incorrect information provided by the Client.
4. Fees and Payment
All fees are quoted in Thai Baht (฿) and include applicable VAT unless otherwise stated. The Firm will confirm the fee for each service before work begins. For fixed-price services, the agreed amount is payable in advance or as set out in the engagement letter.
For the Sustained Support Programme, fees and billing intervals are agreed individually in writing. Any changes to scope or additional work are discussed and agreed with the Client before being undertaken.
Payment is accepted by bank transfer. Receipts are provided for all payments received.
5. Confidentiality
The Firm treats all Client information as strictly confidential. Information shared in the course of an engagement will not be disclosed to third parties without the Client's consent, except where required by Thai law, a court order, or a regulatory obligation.
This duty of confidentiality continues after the engagement concludes.
6. Limitation of Liability
The Firm's liability in respect of any single matter is limited to the fees paid by the Client for that matter, except in cases of fraud or wilful misconduct. The Firm does not accept liability for outcomes that depend on decisions made by pension authorities, courts, or other third parties.
Legal advice reflects the law as it stands at the time advice is given. The Firm is not responsible for changes in law or practice that occur after advice is provided, unless the Client has specifically engaged the Firm for ongoing monitoring.
7. Client Responsibilities
The Client agrees to:
- Provide all relevant documents and information promptly and accurately.
- Inform the Firm of any changes in circumstances that may affect their matter.
- Make payments in accordance with the agreed terms.
- Communicate instructions clearly and confirm significant decisions in writing where requested.
8. Cancellation and Withdrawal
Either party may bring an engagement to a close by giving written notice. Where the Client withdraws after work has commenced, fees are payable for work completed to the date of withdrawal, calculated at the agreed rate or prorated from the fixed fee.
The Firm may decline to continue an engagement if the Client fails to provide necessary information, does not meet payment obligations, or if continuing would conflict with the Firm's professional duties.
9. Complaints
The Firm takes concerns seriously. If you are dissatisfied with any aspect of our service, please contact us in writing at [email protected] or by post to the address below. We aim to acknowledge complaints within three working days and provide a substantive response within fourteen working days.
If a complaint cannot be resolved internally, the matter may be referred to the Lawyers Council of Thailand in accordance with its procedures.
10. Intellectual Property
All materials produced by the Firm in connection with an engagement (advice letters, reports, drafted documents) are provided for the Client's own use in that matter. They may not be reproduced, shared with third parties, or used for any other purpose without the Firm's written consent.
11. Website Use
The content on this website is provided for general information only and does not constitute legal advice. Each person's circumstances differ, and information on this site should not be relied upon as a substitute for professional advice tailored to your situation.
While we take care to keep the website accurate and current, we cannot warrant that all content is error-free or up to date at all times. Links to third-party websites are provided for convenience; the Firm is not responsible for their content.
12. Governing Law
These Terms are governed by the laws of Thailand. Any dispute arising from or in connection with these Terms shall be subject to the jurisdiction of the Thai courts.
13. Changes to These Terms
The Firm may update these Terms from time to time. The current version is always available on this website. Where changes are material, clients with active engagements will be notified. Continued use of our services after notice of changes constitutes acceptance of the revised Terms.
